1. Agreement to Terms
By accessing or using RentEQ ("the Service"), you agree to be bound by these End-User License Agreement terms ("Agreement"). If you do not agree to abide by the above, please do not use this service.
2. License Grant
RentEQ grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for the purpose of browsing available equipment and making rental bookings with participating rental yards. This license does not permit you to resell or make any commercial use of the Service.
3. Rental Terms and Conditions
Booking and Payment: Rental bookings made through RentEQ are contracts between you and the rental yard. You agree to pay all charges incurred, including rental fees, delivery charges, late fees, and damage assessments, using the payment method provided at booking.
Cancellation Policy: Each rental yard sets its own cancellation policy. Your specific cancellation terms are provided at the time of booking and are binding on your rental. Refund eligibility is determined by the yard's policy in effect at the time of cancellation.
Late Fees: Equipment must be returned by the scheduled return date and time. Late fees accrue daily from the equipment's configured late fee rate. You are responsible for all late fees incurred.
Equipment Condition: You agree to inspect equipment upon receipt and report any pre-existing damage to the rental yard immediately. You are responsible for the safekeeping and proper use of rented equipment. You agree to return equipment in the same condition as received, normal wear and tear excepted.
4. Liability and Damages
Equipment Damage: You are fully liable for any damage to rented equipment beyond normal wear and tear. The rental yard will assess damage and you will be charged for all repair or replacement costs at the yard's standard rates.
Loss or Theft: You are responsible for the equipment while in your possession. If rented equipment is lost or stolen, you will be charged the full replacement cost.
Limitation of Liability: RentEQ is provided "as is" without warranties. To the fullest extent permitted by law, RentEQ and participating rental yards shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or rental of equipment, even if advised of the possibility of such damages.
5. Waivers and Risk Assumption
When required by the rental yard, you agree to sign a waiver assuming all risks associated with the use of rented equipment. You acknowledge that equipment use carries inherent risks and agree to use equipment safely and in accordance with all applicable laws and the yard's instructions.
6. User Responsibilities
Accurate Information: You agree to provide accurate, current, and complete information when making bookings. You are responsible for maintaining the confidentiality of your account credentials.
Lawful Use: You agree not to use the Service for any illegal purpose or in any way that violates these terms. You will not use rented equipment in a manner that violates applicable laws or regulations.
Age Requirement: You must be at least 18 years old to use this Service and enter into rental agreements.
7. Dispute Resolution
Any disputes arising from your rental or use of the Service shall first be addressed directly with the rental yard. If a dispute cannot be resolved through direct communication, you agree to submit to binding arbitration or mediation as specified by the rental yard's policies. You waive your right to pursue claims in court or as part of a class action.
8. Intellectual Property
All content, features, and functionality of the RentEQ Service (including but not limited to all information, software, and text) are owned by RentEQ, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.
9. Termination
RentEQ may terminate or suspend your access to the Service at any time, without notice, for conduct that violates these terms or is otherwise harmful to the Service or other users.
10. Changes to These Terms
RentEQ reserves the right to modify these terms at any time. Changes become effective upon posting to the Service. Your continued use of the Service following any changes constitutes your acceptance of the new terms.
